Terms of Service – Wavi One

1. Introduction and Acceptance

Welcome to Wavi One! These Terms of Service (“Terms”) govern your purchase, download, installation, activation, and use of digital products, including WordPress themes and plugins like “WaviBot AI Chatbot CRM”, software, and applications (collectively, the “Products”) offered by Wavi One (“we,” “us,” or “our”), operated by Eng. Ahmed M Hassan / New Waves App Development. These Terms also apply to our website (wavi.one – the “Website”), our license activation system (“License Service”), and related support services (collectively, the “Services”).

By accessing the Website, purchasing, downloading, installing, activating, or using any of our Products or Services, you (“User,” “you,” “Licensee”) agree to be bound by these Terms and our Privacy Policy (available here). If you disagree with any part of the terms, you may not access the Services or use the Products.

For Products purchased through third-party marketplaces like Envato Market, your purchase is also subject to that marketplace’s license terms (e.g., Envato Market Regular or Extended License). The underlying code for many of our WordPress Products is licensed under the GNU General Public License version 2 or later (GPLv2+). These Terms supplement, and do not replace, the applicable GPL and marketplace license terms.

2. Product Licenses and Activation

• Purchase License: Acquiring a Product, typically through Envato Market or potentially directly from us, grants you a license to use the Product as defined by the specific license terms accompanying that purchase (e.g., number of sites, usage type).
• Code License (GPL): For WordPress Products, the PHP, JS, CSS, and HTML components are generally licensed under GPLv2+. You have the freedoms granted by the GPL regarding this code.
• Activation Required: Many of our Products, particularly premium plugins like WaviBot, require activation via our License Service using a valid Purchase Code obtained from the point of sale (e.g., Envato). Activation verifies your right to use the Product and receive updates/support. The Product may have limited or no functionality without successful activation.
• Activation Server: The License Service (e.g., license.newwaves.app) is used solely for verifying purchase codes against website domains according to the license terms. We do not collect unnecessary personal data during this process (see Privacy Policy).
• License Restrictions: You agree not to share, resell (unless explicitly permitted by the license, e.g., redistribution under GPL), or misuse your license key/purchase code. You must not attempt to bypass or disable the activation mechanism. Use of the Products must comply with the purchased license terms and applicable laws.

3. AI Features & Third-Party Services

Several Wavi One Products utilize Artificial Intelligence (AI) and may integrate with or rely on third-party services:

• OpenAI (or similar AI Providers): Products like WaviBot require you to obtain and use your own API Key from the AI service provider (e.g., OpenAI).
• Responsibility for API Keys: You are solely responsible for obtaining, managing, securing, and paying for usage associated with your third-party API Keys.
• Third-Party Costs: Use of AI features (like chat generation, embeddings, premium TTS) through our Products will incur costs based on the third-party provider’s pricing (e.g., OpenAI’s token usage fees). Wavi One is not responsible for these costs.
• Third-Party Terms: Your use of third-party services (OpenAI, Google reCAPTCHA, etc.) is governed by their respective Terms of Service and Privacy Policies.
• AI Output Disclaimer: AI-generated content can be unpredictable and may contain inaccuracies or reflect biases present in the training data. Wavi One does not guarantee the accuracy, suitability, or reliability of AI-generated outputs. You are responsible for reviewing and validating AI outputs before relying on them.
• Training Data Responsibility: You are responsible for ensuring you have the rights to use any data you provide for training AI models via our Products and that such data complies with applicable laws and third-party service policies.

4. User Conduct

You agree not to use the Website or Products for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Services/Products in any way that could damage the Website, Services, Products, or general business of Wavi One.

5. Support and Updates

• Support for purchased Products is provided as per the terms outlined on the Envato Market item page (or other point of sale) and typically covers bug fixes and basic usage questions for a specified period.
• Support scope limitations apply (see individual product documentation or Envato page).
• Updates are provided to maintain compatibility and functionality, usually tied to an active license or support subscription as per Envato policies. We reserve the right to discontinue updates for older products, but will strive to provide reasonable notice.

6. Intellectual Property

All content on the Website (text, graphics, logos, images) and the unique branding, design elements, and non-GPL components of our Products are the property of Wavi One (Ahmed M Hassan / New Waves App Development) and protected by copyright and other intellectual property laws. The underlying code of specific components (like WordPress plugins) may be subject to the GPL, as indicated.

THE WEBSITE, SERVICES, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WAVI ONE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR PRODUCTS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF THE INFORMATION, TEXT, GRAPHICS, LINKS OR OTHER ITEMS CONTAINED WITHIN THE SERVICES OR PRODUCTS, INCLUDING AI-GENERATED CONTENT.
